OQTF: what to do in the first 48 hours

As soon as you receive an OQTF, find the appeal deadline stated on the notification and contact a lawyer the same day: the deadline can be very short.

Hour 0: keep everything, photograph everything

Keep the notification, the envelope and all attached documents. Photograph them. The date of notification starts the appeal deadline running.

Find the appeal deadline

The notification states the deadline and the competent court. Depending on the decision, it can range from 48 hours to several weeks. Do not rely on a “usual” deadline: only the one stated on your decision counts.

Gather useful documents

  • passport and residence documents;
  • proof of presence and residence in France;
  • family ties (marriage, children, family record book);
  • employment contract, payslips;
  • children’s schooling, medical certificates.

Contact a lawyer

The appeal must be drafted and filed within the deadline. The earlier you contact the firm, the more carefully the file can be prepared. If you are placed in detention, call immediately.

Do not ignore the measure

Failing to challenge an OQTF in time normally makes it final. Do not ignore it, or leave, without advice either: the consequences (an entry ban, for example) can be serious.
